{"id":1525,"date":"2022-12-18T13:34:03","date_gmt":"2022-12-18T13:34:03","guid":{"rendered":"https:\/\/davidhealy.com\/?p=1525"},"modified":"2024-05-01T09:36:40","modified_gmt":"2024-05-01T09:36:40","slug":"commissioner-for-environmental-information-upholds-appeal-in-relation-to-planning-file-for-station-road-housing","status":"publish","type":"post","link":"https:\/\/davidhealy.com\/?p=1525","title":{"rendered":"Commissioner for Environmental Information has upheld my appeal on refusal of access to information on Station Road junctions"},"content":{"rendered":"\n<p>The <a rel=\"noreferrer noopener\" href=\"http:\/\/ocei.ie\" data-type=\"URL\" data-id=\"ocei.ie\" target=\"_blank\">Commissioner for Environmental Information<\/a> has ruled on my appeal against Fingal County Council&#8217;s refusal to release planning compliance documentation in relation to condition 2 of planning permission <a href=\"https:\/\/www.pleanala.ie\/en-ie\/case\/305619\" data-type=\"URL\" data-id=\"https:\/\/www.pleanala.ie\/en-ie\/case\/305619\" target=\"_blank\" rel=\"noreferrer noopener\">SHD\/012\/19<\/a>.  The condition required the redesign of the junctions at either end of Station Road before development started, which didn&#8217;t happen. One has since been redesigned. The other still hasn&#8217;t. More background <a rel=\"noreferrer noopener\" href=\"https:\/\/davidhealy.com\/?p=1389\" data-type=\"URL\" data-id=\"https:\/\/davidhealy.com\/?p=1389\" target=\"_blank\">here.<\/a><\/p>\n\n\n\n<p>The Commissioner found<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><a rel=\"noreferrer noopener\" href=\"https:\/\/davidhealy.com\/wp-content\/uploads\/2022\/12\/DecisionOCE-116384-Y4R5W2Signed.pdf\" data-type=\"URL\" data-id=\"https:\/\/davidhealy.com\/wp-content\/uploads\/2022\/12\/DecisionOCE-116384-Y4R5W2Signed.pdf\" target=\"_blank\">36. Articles 7(4) and 11(4) of the AIE Regulations require public authorities to provide reasons for refusal at both original and internal review decision stages, consistent with Article 4(5) of the AIE Directive. It is clear that the Council did not provide adequate reasons for refusal of the appellant\u2019s request.<\/a><\/p><p><a rel=\"noreferrer noopener\" href=\"https:\/\/davidhealy.com\/wp-content\/uploads\/2022\/12\/DecisionOCE-116384-Y4R5W2Signed.pdf\" data-type=\"URL\" data-id=\"https:\/\/davidhealy.com\/wp-content\/uploads\/2022\/12\/DecisionOCE-116384-Y4R5W2Signed.pdf\" target=\"_blank\">37.
