{"id":189,"date":"2006-10-12T13:15:42","date_gmt":"2006-10-12T13:15:42","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"-0001-11-30T00:00:00","slug":"Accountability_and_Democracy_in_Fingal_County_Council?","status":"publish","type":"post","link":"https:\/\/davidhealy.com\/?p=189","title":{"rendered":"Accountability and Democracy in Fingal County Council?"},"content":{"rendered":"<p>In theory, Councillors set the policy and the Manager implements it.&nbsp; The practice is quite different.&nbsp; <\/p>\n<p>Take, for example, the proposal for a <a href=\"http:\/\/www.davidhealy.com\/index.php?option=com_content&#038;task=view&#038;id=144&#038;Itemid=40\" target=\"_self\">dual carriageway from Baldoyle to Blanchardstown<\/a>, parallelling the M50 motorway and with flyover junctions in the middle of new residential areas.&nbsp; This road is not in the County Development Plan and has never been voted on by Councillors. Yet already millions have been spent on consultants and a road design and Environmental Impact Statement is being drawn up.&nbsp; The entire focus is on the impossible task of providing enough road capacity for this high-density development.&nbsp; Public transport is being treated as an afterthought.<\/p>\n<p>I believe that whenever the officials intend to appoint consultants, then the terms of reference should be brought before the Councillors.&nbsp; The current system brings us the proposal at the very end of the process and expects us to rubber-stamp it.&nbsp; At that stage most Councillors aren&#8217;t willing to upset the apple-cart and go along with whatever is proposed, even if communities are opposed.<\/p>\n<p>Next Tuesday at the adjourned Council meeting, the following motion of mine will be discussed.&nbsp; What happens to it will be of considerable significance for democracy in Fingal. <\/p>\n<p><strong><span class=\"contentpane\"><br \/><\/span><\/strong><\/p>\n<p><strong><span class=\"contentpane\">51. Cllr. D. Healy<\/span><\/strong><\/p>\n<p><span class=\"contentpane\"><br \/>&ldquo;That the Council, in order to<br \/>\nhave effective and timely input by the elected Council into the work being done<br \/>\nby consultants for the Council who are often preparing work which will lead to<br \/>\ndecisions by the Council in exercise of reserved functions, in exercise of its<br \/>\npowers under section 138 (2) and (3) of the Local Government Act 2001 which<br \/>\nprovide as follows:<\/span><\/p>\n<blockquote>\n<p><span class=\"contentpane\">&ldquo;138 (2) Subject to this section,<br \/>\nan elected council or joint body may by resolution direct that, before<br \/>\nthe manager performs any specified executive function of the local<br \/>\nauthority or joint body, he or she shall inform the elected council or<br \/>\njoint body, as the case may be, of the manner in which he or she<br \/>\nproposes to perform that function, and the manager shall comply with the<br \/>\nresolution.<\/span><\/p>\n<p><span class=\"contentpane\">&nbsp;&ldquo;138 (3) A resolution under subsection (2) may relate to any<br \/>\nparticular case or occasion or to every case<br \/>\nor occasion of the performance of the specified executive function<br \/>\nand may define what information is to be given and how and when it<br \/>\nis to be given and the manager shall comply with the<br \/>\nresolution.&rdquo;<\/span><\/p>\n<\/blockquote>\n<p><span class=\"contentpane\">&nbsp;and noting<br \/>\ns.138(4) which provides as follows<\/span><\/p>\n<blockquote>\n<p><span class=\"contentpane\">&nbsp;&ldquo;138 (4) Nothing in this section<br \/>\nprevents the manager from dealing immediately with any situation<br \/>\nwhich he or she considers is an emergency situation calling for immediate<br \/>\naction without regard to subsections<br \/>(1) to (3).&rdquo;<\/span><\/p>\n<\/blockquote>\n<p><span class=\"contentpane\">by this resolution <strong>directs that<br \/>\nin every case or occasion when the manager proposes to perform the executive<br \/>\nfunction of entering into a contract to appoint consultants he notify the<br \/>\nelected Council of the manner in which he proposes to perform that function and<br \/>\nthat he do this by bringing the proposed brief or terms of reference to the<br \/>\nrelevant Area Committee or Strategic Policy Committee as a headed item for<br \/>\ntheir consideration.&rdquo;<\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In theory, Councillors set the policy and the Manager implements it.&nbsp; The practice is quite different.&nbsp; Take, for example, the proposal for a dual carriageway from Baldoyle to Blanchardstown, parallelling the M50 motorway and with flyover junctions in the middle of new residential areas.&nbsp; This road is not in the County Development Plan and has [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":[],"categories":[],"tags":[],"_links":{"self":[{"href":"https:\/\/davidhealy.com\/index.php?rest_route=\/wp\/v2\/posts\/189"}],"collection":[{"href":"https:\/\/davidhealy.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/davidhealy.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/davidhealy.com\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/davidhealy.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=189"}],"version-history":[{"count":0,"href":"https:\/\/davidhealy.com\/index.php?rest_route=\/wp\/v2\/posts\/189\/revisions"}],"wp:attachment":[{"href":"https:\/\/davidhealy.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=189"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/davidhealy.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=189"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/davidhealy.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=189"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
