I have made the following response to the proposed parking bye-laws which the Executive of Fingal County Council has put on public display.
Legality
Part 19 of the Local Government Act 2001 includes the following provision:
s.199 (5) The approval of a draft bye-law, the consideration of submissions in relation to such draft bye-law and the making, amendment or revocation of a bye-law, are each reserved functions.
This draft bye-law hasn’t been brought to the Council for approval.
Charging for parking in some Council car parks
It had been understood that the changes being proposed to the bye-laws were as regards the rates for paid parking. However, the draft that has gone on display includes the introduction of parking charges for a number of car parks managed by the Council. Some Council-managed car parks are included in the new charges (including some little-used car parks) whereas other Council car parks are excluded. No explanation has been offered for this proposal.
I support the use of car parking charges to manage the availability of parking spaces, and to address traffic congestion and modal share. However, this needs to be done on in response to these challenges. It also needs to be done in a way which will not simply displace parked cars to nearby areas where parking is free. No evidence or analysis has been supplied as to the existing situation at these car parks or in their vicinity, nor on the knock-on effects on neighbouring areas.
Apartments
The bye-laws discriminate against apartment residents, preventing them from applying for residents’ permits and against their carers and visitors, who are also prevented for applying for permits.
Parking in Howth
Howth has a significant challenge with car parking and traffic congestion on sunny weekends. The Area Committee approved a motion of mine in April 2025 which read:
“That the Chief Executive consult with the Howth Harbourmaster and the Department of Agriculture Food and the Marine with a view to preparing integrated proposals for pay and display parking control in Howth for discussion with this Area Committee and public consultation.”
This motion was agreed. No changes should be made to any off-street parking in Howth in advance of an integrated approach being developed and put to public consultation.
